Another Court Rejects Mais Decision and Upholds FCC’s Interpretation of “Prior Express Consent” in the TCPA

Federal court dismisses TCPA class action finding that providing a cell phone number to a health care provider constitutes prior express consent to be called at that number using an autodialer in an attempt to collect a debt. On June 25, 2014, a U.S. District Court dismissed a class action suit claiming violations of the Telephone Consumer Protection Act (TCPA) for a series of autodialed calls made by a health care provider to a consumer’s cellular telephone number attempting to collect payment for medical treatment previously given. <more>
